Dumpster diving is legal in Texas on public land (e.g. trucks, alleys). A local ordinance may prohibit dumpster diving locally. Nevertheless, dumpster diving on an owner-occupied premise, such as the ones found behind establishments, in a compounded section, or where the owner may have erected No Trespassing signs, may imply trespass to charge, according to the Texas Penal Code, 30.05. Local city policies should always be checked.
